The new legislative framework aims to streamline the daily procedures for French economic players, particularly in their access to public procurement. By 2030, the single digital platform « Place » will centralise all public contracts from the State, its various operators, hospital establishments, and social security organisations. In parallel, the legislation raises the threshold for exemption from advertising for works contracts and introduces a lot reservation scheme specifically dedicated to young innovative companies. To facilitate business transfers, the text removes the obligation to directly inform employees in structures with more than 50 staff, and reduces this period from two to one month in smaller entities.

Supporting Commercial Cash Flow and Accelerating Industrial Projects

Local businesses benefit from targeted measures designed to protect their cash flow against competition from large online commerce platforms. The law thus enshrines the monthly payment of commercial rents at the tenant’s request, while capping the amount of security deposits at a maximum of three months’ rent. Regarding industrial development and ecological transition, the executive introduces derogations to accelerate the deployment of infrastructure, whether it be relay antennas or large data centres. The latter may also be recognised as major projects of national interest, thereby simplifying their connections, although the granting of a building permit remains conditional on the preservation of local water resources.

A Clearer Framework for Banks and Insurers

Contractual relationships with financial institutions are subject to a reinforced framework to prevent abuses and simplify the day-to-day management of very small businesses (VSEs) and small and medium-sized enterprises (SMEs). The free closure of professional accounts is now an absolute rule guaranteed by law, complemented by the obligation for banks to send a free annual fee statement from 2027. In the insurance sector, compensation deadlines are rationalised: they cannot exceed six months in the presence of an expert assessment, and two months in its absence. Furthermore, professionals finally gain the right to cancel their insurance contracts at any time after one year of subscription.
